Responsible Employee

At UCI, employees, who are not confidential employees* are required to report to OEOD/Title IX when they learn, in the course of employment,  that a student may have experienced discrimination or harassment, sexual harassment, or sexual violence including sexual assault, dating or domestic (relationship) violence, stalking, invasions of sexual privacy, or other sexual misconduct. This includes student-employees who are resident assistants, graduate teaching assistants, and other student employees when disclosures are made in their capacity as employees.

UCIPD, HR Administrators, Academic Personnel Administrators, OEOD/Title IX staff, Managers and Supervisors, Deans, Department Chairs, Directors of Organized Research Units and all faculty are required to report to OEOD/Title IX when they learn that an employee or any other person affiliated with the University, including patients, have experienced discrimination or harassment, sexual harassment, or sexual violence including sexual assault, dating or domestic (relationship) violence, stalking, invasions of sexual privacy, or other sexual misconduct.

Responsible Employees must report to OEOD/Title IX regardless of whether significant time has passed since the alleged incident, it occurred off property, or involves non-affiliates.

Upon receipt of a report, OEOD/Title IX will outreach to the individual to provide applicable information on their rights, options, and resources. OEOD/Title IX sends this outreach over email. Making a responsible employee report does not automatically mean an investigation will be initiated; rather, OEOD will provide resources and information to the person impacted.

*confidential employees include CARE, the Ombudsman, licensed counselors in student counseling centers, and employee assistance programs such as EAP and faculty/staff support services.

Failures in Responsible Employee Reporting

In December 2020, the UC Office of the President issued guidance requiring Title IX Offices to respond to Responsible Employee failures to report, including referral for disciplinary action and additional training, or formal investigation of employee failure to report to Title IX. At UCI, OEOD/Title IX implements this guidance by assessing the nature of the failure and impact to community. For questions, please contact the Title IX Officer.
